Claims by Binding Arbitration

Experian Information Solutions, Inc. (“Experian”) is committed to customer satisfaction. Part of that commitment is ensuring that any dispute a customer may have related to an Experian service is resolved in a fair, effective, and efficient manner. Most customer concerns can be resolved quickly and to the customer's satisfaction by contacting the applicable Experian Customer Service Department. In the unlikely event that Experian's Customer Service Department is unable to resolve a complaint you may have to your satisfaction (or if Experian has not been able to resolve a dispute it has with you after attempting to do so informally), we each agree to resolve those disputes through binding arbitration or small claims court instead of in courts of general jurisdiction to the fullest extent permitted by law. Arbitration is more informal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, allows for more limited discovery than in court, and is subject to very limited review by courts. Arbitrators can award the same damages and relief that a court can award. Any arbitration under our Agreement will take place on an individual basis; class arbitrations and class actions are not permitted. Experian will pay all costs of arbitration, no matter who wins, so long as your claim is not frivolous. However, in arbitration, both you and Experian will be entitled to recover attorneys’ fees from the other party to the same extent as you would be in court. Accurate adverse information on your credit report cannot be changed. If you believe that your Experian consumer credit report contains inaccurate or fraudulent information, it is your responsibility to contact Experian’s National Consumer Assistance Center to dispute information. If you are an Experian Connect customer, you may request a consumer file disclosure at no charge within 60 days of ordering your Credit Information (consumer credit report and VantageScore credit score) by contacting Experian’s National Consumer Assistance Center at www.experian.com/rs/fi64.html.
